Understanding Deprivation of Liberty in Health, Social Care and Community Settings

1-day training course around Deprivation of Liberty

Outline

This one-day course is for qualified professionals and practitioners (e.g. Social Workers), and managers of health and social care services (e.g. ward managers, and managers of care homes and supported living services) who need to have a good understanding of what constitutes a deprivation of liberty and how to ensure any deprivation of a person’s liberty is lawful.

Description

By the end of the course participants will be able to:

  • Consider what constitutes a deprivation of liberty (including an understanding of the “Acid Test” and the context of deprivation of liberty in relation to human rights) and give practical examples
  • Define a restriction or a restraint within the context of health and social care provision, and explain the types of restrictive practices used within their services
  • Understand how the principles of the Mental Capacity Act can support restrictive practice within health and social care services, and protect staff and professionals from liability
  • Describe the process of authorising a deprivation of liberty for those people to whom the Deprivation of Liberty Safeguards (DOLS) apply in Trafford (including the application process, the assessments and types of authorisation)
  • Identify roles and responsibilities within the DOLS processes
  • Explain how care and support regimes that amount to a deprivation of liberty would be authorised when they fall outside the scope of the DOLS, such as community settings (including the role of the Court of Protection)
